ORDINANCE NO. 51
 
OUTDOOR BURNING ORDINANCE
 
 
An ordinance to regulate the burning of leaves, recreational fires, cooking fires, and all other outdoor burning within the Village of Fairgrove.
 
THE VILLAGE OF FAIRGROVE ORDAINS:
 
Section 1. General Outdoor Burning Prohibited
 
Section 2. Camp Fires
 
Recreational camp fires shall be allowed without a permit provided they comply with the following requirements:
 
A.                             A camp fire is defined as an outdoor fire used for recreational purposes such as a cooking fire.
B.                            Such fires shall be limited to a barbeque grill, fire pit or container no larger than thirty-six (36) inches in diameter.
C.                            Camp fires shall be restricted to rear yard areas only.
D.                            Materials burned in camp fires are restricted to clean wood only and shall not include garbage, debris, plastics, Styrofoam, treated or painted wood or similar items.
E.                            No accelerant such as gasoline and kerosene shall be used, with the exception of charcoal lighter fluid.
F.                             The fire shall be under the immediate supervision of a responsible person of at least eighteen (18) years of age.
G.                            There shall be an operational water source (such as a garden hose) available at the fire site at all times.
H.                            Camp fires shall no be allowed if the emission of smoke and fumes irritate, annoy or constitute a nuisance to others living in the neighborhood
 
Section 3. Penalty
 
Any person or entity that violates any provision of this Ordinance shall be responsible for
a municipal civil infraction and subject to payment of a civil fine of not less than One Hundred and 00/100 ($100.00) Dollars, plus costs and other sanctions as set forth in Civil Infraction Ordinance No. 49 for each infraction. Repeat violations of this Ordinance shall
be subject to increased fines and other sanctions as provided by Ordinance No. 49. Furthermore, any violation shall be subject to such injunctive relief as granted by the Court.
 
 
 
Section 4. Repeal
 
The former Village of Fairgrove Open Burning Ordinance No. 51, adopted May 5, 2003, is hereby repealed in its entirety.
 
The undersigned President and Clerk of the Village of Fairgrove hereby certify that this Ordinance was duly adopted by the Fairgrove Village Council at a meeting held on the  20th day of July, 2009 and a synopsis thereof was published in the Tuscola County Advertiser on the 8th day of August, 2009. This Ordinance shall take effect twenty (20) days after said date of adoption, which is August 10, 2009.
